2. GENERAL PROVISIONS RELATING TO THESE TERMS AND CONDITIONS
These Terms and Conditions apply exclusively to the online sale of the products offered on our website.
These Terms and Conditions are made available to customers on our website, where they can be consulted directly, and may also be sent to customers on request by any means.
These Terms and Conditions are binding on the customer, who acknowledges, by creating a customer account and/or placing an order, that they have read and accepted them. Validating the order by confirming it constitutes the buyer's acceptance of the Terms and Conditions in force on the day of the order.
3. PRODUCT DESCRIPTION
Our website is an online store selling refurbished electronic products, open to any natural or legal person using our website.
Each product presented on our website comes with a description of its essential characteristics. The photographs illustrating the products, where applicable, are not contractual documents. The products comply with the requirements of the law in force.
The customer remains responsible for the terms and consequences of their access to our website, in particular through their personal internet connection. This access may involve fees charged by technical providers, such as internet service providers, which remain the customer's responsibility. In addition, the customer must provide, and is fully responsible for, the equipment needed to connect to our website.
The customer acknowledges having checked that the computer configuration they use is secure and in working order.
4. CREATING A CUSTOMER ACCOUNT
To place an order on our website, the customer must first create a personal customer account. Once it is created, the customer accesses it by identifying themselves with their email address and their secret, personal and confidential password. The customer must not disclose their login or their password, in accordance with these Terms and Conditions. Each customer undertakes to keep strictly confidential the data, in particular the login and password, that gives access to their customer area, and acknowledges being solely responsible for access to the service through their login and password, except in the event of proven fraud. Each customer also undertakes to inform us without delay of any loss, misappropriation or fraudulent use of their login and/or password.
After creating their customer account, the customer will receive an email confirming that the account has been created.
When registering, the customer undertakes to:
- provide real, accurate and up-to-date information when entering it in the registration form, and in particular not to use false names or addresses, or names or addresses they are not authorised to use;
- keep their registration data up to date so that it always remains real, accurate and current.
The customer also undertakes not to make available or distribute any unlawful or objectionable information (such as defamatory information or information constituting identity theft) or any harmful content (such as viruses). Otherwise, we may suspend or terminate the customer's access to our website, at the customer's sole fault.
5. ORDERS
We strive to ensure the best possible availability of our products. Our products are offered while stocks last.
If a product turns out to be unavailable after the customer has ordered it, we will inform the customer by email as soon as possible, and the customer may choose between:
- the delivery of a product of equivalent quality and price to the one originally ordered, or
- the refund of the price of the product ordered, at the latest within thirty (30) days of payment of the sums already paid.
It is agreed that, apart from refunding the price of the unavailable product if the customer chooses this option, we shall not owe any cancellation compensation.
Except where otherwise stated in these Terms and Conditions, and without prejudice to the right of withdrawal provided by the law applicable in your country, the customer's orders are firm and final.
When placing an order, the customer selects the chosen products and adds them to their basket, indicating the products selected and the quantities wanted. The customer can check the details of their order and its total price, and go back to the previous pages to correct the contents of their basket if needed, before validating it.
The customer undertakes to read the Terms and Conditions in force before accepting them, and to confirm the delivery terms and any delivery and withdrawal costs before paying for their order. Confirming the order entails acceptance of the Terms and Conditions and forms the contract.
The contractual information relating to the order (including the order number) will be confirmed by email in due course and at the latest at the time of delivery. We strongly advise the customer to print and/or archive this order confirmation on a reliable and durable medium as proof. A digital invoice is made available to the customer in their customer area. We also advise the customer to print and/or archive this invoice on a reliable and durable medium as proof.
Any email sent to the customer in connection with an order is sent to the email address the customer uses to log in to their customer area.
We reserve the right not to validate the customer's order for any legitimate reason, in particular where:
- the customer does not comply with the Terms and Conditions in force at the time of the order;
- the customer's order history shows that sums remain due for previous orders;
- one of the customer's previous orders is the subject of a dispute being processed;
- the customer has not answered a request to confirm their order that we sent them.
Any change to an order by the customer after it has been confirmed is subject to our agreement.
The information provided by the customer when placing the order (in particular the name and the delivery address) is binding on them. We can therefore in no way be held liable if an error made when placing the order prevents or delays delivery.
The customer declares that they have full legal capacity to commit under these Terms and Conditions.
Registration is open to adults with legal capacity, and to minors provided they act under the supervision of the parent or guardian holding parental authority. Registration on behalf of a third party is never allowed unless the person is duly authorised to represent that third party (a legal entity, for example). Registration is strictly personal to each customer.
The products sold on our website may not be resold or used for military purposes.
If the customer breaches any of these provisions, we reserve the right to close that customer's account without notice.
6. PAYMENT TERMS AND SECURITY
The customer expressly acknowledges that any order placed on the website is an order with an obligation to pay, which requires the payment of a price in return for the supply of the product ordered.
In any event, we reserve the right to check the validity of the payment by any necessary means before the order is shipped.
Orders can be paid by bank card or by the alternative payment methods offered. Payment is made directly on the secure banking servers of our financial partners; the customer's bank details do not pass through our website. The bank details provided during payment are protected by SSL (Secure Socket Layer) encryption, so they are not accessible to third parties.
The customer's order is recorded and validated as soon as the customer's bank accepts the payment.
The customer is debited for the corresponding amount only once the details of the bank card used have been verified and the debit has been accepted by the bank that issued the card.
If the sums due cannot be debited, the sale is immediately void.
The bank card may be refused, in particular, if it has expired, if it has reached the maximum spending limit the customer is entitled to, or if the details entered are incorrect.
Where applicable, the order validated by the customer is only considered effective once the secure payment centre has approved the transaction.
As part of our verification procedures, we may ask the customer for any documents needed to complete their order. These documents are not used for any other purpose.
7. PAYMENT OF THE PRICE
The price of the products in force at the time of the order is shown in the currency of your country, excluding delivery costs, transport costs and any customs duties. In the event of a promotion, we undertake to apply the promotional price to any order placed during the period in which the promotion is advertised.
The price is payable exclusively in the currency of your country. The full price is due once the order has been confirmed.
If delivery or transport costs apply, they are added to the price of the products and shown separately before the customer validates the order. The total amount due by the customer and its breakdown are shown on the order confirmation page.
8. FORMATION OF THE CONTRACT
The contract between our company and the customer is formed when the customer sends the confirmation of their order.
Communications, orders and invoices are archived by our services on a reliable and durable medium so as to constitute a faithful and durable copy. These communications, order forms and invoices may be produced as proof of the contract.
The customer may cancel the order by simply emailing our services in the event of:
- delivery of a product that does not match the declared characteristics of the product;
- delivery after the deadline set in the order form or, failing such a date, within thirty (30) days of the conclusion of the contract, after we have been asked, in the same way and without result, to deliver within a reasonable additional period.
The order may be cancelled in the event of:
- the buyer's refusal to take delivery;
- non-payment of the price (or of the balance of the price) at the time of delivery.
9. RETENTION OF TITLE
We remain the sole owner of the products ordered on our website until the full price has been received, including any shipping costs.
10. SHIPPING AND DELIVERY
The products and services presented on our website are offered to consumers worldwide.
Delivery means the transfer to the customer of physical possession or control of the product.
Shipping costs are those specified when the order is finalised and are accepted when the order is validated.
In accordance with the delivery deadline shown on our website for each product, we undertake to deliver the products within a maximum of thirty (30) days after receiving full payment for the order.
Delivery times are announced in working days on our website when ordering. These times include the preparation and shipping of the order as well as the time taken by the carrier.
We undertake to ship the products within the times announced on each product page and in the basket, provided that payment for the order has not previously been refused.
The products are delivered to the address given by the customer when ordering. It is therefore up to the customer to check that this address contains no error. We cannot be held liable if the address provided by the customer is incorrect and thereby prevents or delays delivery.
On delivery, you may be asked to sign a delivery receipt.
No delivery is made to a post office box.
On delivery, it is up to the customer to check that the products delivered match their order and that the parcel is sealed and undamaged. If this is not the case, the customer must state it on the delivery slip. No claim regarding the quantity or condition of the product will be accepted if it has not been recorded on the delivery slip.
11. RIGHT OF WITHDRAWAL
If a delivered product does not fully satisfy the customer, they may return their order to us within thirty (30) days of the date of receipt of the order.
We will acknowledge receipt of the customer's withdrawal request by email.
In the event of withdrawal, the cost of returning the parcel is borne by you. Administrative fees may apply in the event of withdrawal if the product received has no defect.
The returned product must be in its original packaging, in perfect condition, fit for resale, unused and with all the accessories supplied.
In addition to the returned product, the return parcel must contain a letter stating the customer's exact and complete details (surname, first name, address), the order number and the original purchase invoice. This information will be sent to the customer by email.
We undertake to refund the customer the amount of the product within fourteen (14) days of receiving the product and all the information needed to process the refund. The refund may be made using the same payment method as the one used by the customer. Accordingly, customers who paid for their order with a voucher are refunded with a voucher.
By accepting these Terms and Conditions, the customer expressly acknowledges having been informed of the withdrawal conditions.
12. CUSTOMER SERVICE

13. INTELLECTUAL PROPERTY AND LICENCE TO USE THE WEBSITE
Allo Allo is the sole owner of all the elements present on the website, including without limitation all texts, files, animated or still images, photographs, videos, logos, drawings, designs, software, trademarks, visual identity, databases, the structure of the website and all other intellectual property elements and other data or information, which are protected by international laws and regulations relating in particular to intellectual property.
Consequently, no element of our website may be modified, reproduced, copied, duplicated, sold, resold, transmitted, published, communicated, distributed, broadcast, represented, stored, used, rented or exploited in any other way, in whole or in part, free of charge or for a fee, by a customer or by a third party, whatever the means and/or media used, whether known or unknown to date, without our prior express written authorisation on a case-by-case basis, and the customer is solely responsible for any unauthorised use and/or exploitation.
We reserve the right to take any legal action against persons who have not complied with the prohibitions contained in this article.
14. LIABILITY AND WARRANTY
We cannot be held liable for a failure to perform the contract caused by the customer, by an event qualified as force majeure by the competent courts, or by the unforeseeable and insurmountable act of any third party.
The customer acknowledges that the characteristics and constraints of the internet do not make it possible to guarantee the security, availability and integrity of data transmissions over the internet. We therefore do not guarantee that our website and its services will operate without interruption or error. In particular, their operation may be temporarily interrupted for maintenance, updates or technical improvements, or to change their content and/or presentation.
We cannot be held liable for any use of the website and its services by customers in breach of these Terms and Conditions, or for any direct or indirect damage that such use may cause to a customer or to a third party.
Independently of any additional contractual warranty (commercial warranty) that may be granted, the products benefit from the legal guarantee of conformity and the guarantee against hidden defects.
When you act under the legal guarantee of conformity:
- you have two (2) years from the delivery of the product to act;
- you are not exempt from proving the existence of the lack of conformity of the product during the twenty-four (24) months following its delivery.
In the event of a lack of conformity, the buyer will be offered a replacement of the product. However, the customer will first receive a voucher for the amount of the product on the day the return parcel is received. This voucher can be used to order a new product on our website. If the return request is registered within 30 days of receiving the order, the voucher can be converted into a refund.
Please note that seeking an amicable solution before any legal action does not interrupt the time limits for acting under the legal guarantees, nor the duration of any contractual warranty.
15. AFTER-SALES SERVICE
Claims under the warranties must be sent by email to:
help@alloallo.com
Products covered by the warranties must be returned complete, in their original condition and packaging, after the after-sales service has received and confirmed the claim.
In the event of a proven defect in the product, the customer is refunded the return postage costs at the latest within thirty (30) days of receipt of the returned product.
16. PERSONAL DATA
For more information on the use of personal data, please read our Privacy Policy carefully, which you can consult on our website at any time.

18. REFERENCES
The customer authorises Allo Allo to mention the customer's name and logo as a reference in its communication materials (brochures, website, commercial proposals, press relations, press releases, press kits, internal communication, etc.).
19. GENERAL PROVISIONS
ENTIRE AGREEMENT
These Terms and Conditions constitute a contract governing the relationship between the customer and Allo Allo. If one or more provisions of these Terms and Conditions are declared null and void pursuant to a law or regulation or following a final decision of a competent court, the other provisions retain their full force and scope. In addition, the fact that one of the parties does not invoke a breach by the other party of any of the provisions of these Terms and Conditions shall not be interpreted as a waiver of its right to invoke such a breach in the future.
CHANGES TO THE TERMS AND CONDITIONS
We reserve the right to modify the content of our website or of the services available on it at any time and without notice, and/or to stop operating all or part of our website temporarily or permanently.
We also reserve the right to change the location of our website on the internet, as well as these Terms and Conditions, at any time and without notice. The customer must therefore refer to these Terms and Conditions before any use of our website.
The customer acknowledges that Allo Allo cannot be held liable in any way to them or to any third party for such modifications, suspensions or discontinuations.
We advise the customer to save and/or print these Terms and Conditions for safe and durable keeping, so that they can rely on them at any time during the performance of the contract if necessary.
GOVERNING LAW
These Terms and Conditions are governed, interpreted and applied in accordance with international law.
ACCEPTANCE OF THE TERMS AND CONDITIONS BY THE CUSTOMER
The customer acknowledges having read these Terms and Conditions carefully.
By registering on our website and placing an order, the customer confirms having read and accepted the Terms and Conditions, which makes them contractually bound by their terms.
The Terms and Conditions applicable to the customer are those available on the date of the order; any later change to the Terms and Conditions therefore does not apply to orders placed before it.
